Filing Form I-864 Affidavit of Support
Legal and Administrative Actions:
- Complete Form I-864 to show that the petitioner or sponsor has enough income or assets to support the intending immigrant.
- Provide proof of income such as federal tax returns, W-2s, pay stubs, or evidence of assets.
- Confirm that the sponsor meets at least 125% of the Federal Poverty Guidelines (100% if active duty military sponsoring a spouse or child).
- Attach additional household member support contracts (Form I-864A) if needed to meet income requirements.
- Sign the form to create a legally binding contract, enforceable by the U.S. government.
- Submit the I-864 with the immigrant visa application (NVC) or adjustment of status filing (USCIS).
Time: Prepared and filed with the green card application. Remains in effect until the immigrant becomes a U.S. citizen, has 40 qualifying quarters of work, or the obligation otherwise ends by law.
