Filing an EOIR-29 Appeal with the Board of Immigration Appeals
Legal and Administrative Actions:
- Prepare an EOIR-29 after a denial of Form I-130 or I-360.
- File an appeal within 30 days with the same DHS office that issued the denial.
- File an EOIR-27, if an attorney or representative is involved.
- Pay the required filing fee and retain proof of filing.
- Compile and submit a written explanation of the errors in the denial.
- Track the status of the appeal and respond to requests for additional documents.
Time: 30 days — filing deadline after denial. 6–18 months — typical appeal processing time. Longer — if new evidence or petitions are added.
Estimated Cost:
$1,010 is the current filing fee set by EOIR (subject to change).
Additional costs include attorney fees, document preparation, and mailings.
